Delhi High Court Orders Baba Ramdev to Remove ‘Sharbat Jihad’ Ads

In a significant legal development, the Delhi High Court has directed Baba Ramdev’s Patanjali Ayurved to immediately withdraw advertisements referring to Hamdard’s Rooh Afza as “Sharbat Jihad.” Justice Amit Bansal expressed his astonishment, stating, “I couldn’t believe my eyes and ears,” upon reviewing the content.

The controversy began when Ramdev, in a promotional video for Patanjali’s summer drink, claimed that profits from Rooh Afza were used to fund the construction of mosques and madrasas. He further criticized the product, suggesting it was akin to “toilet cleaners sold in the name of soft drinks.”

Representing Hamdard, Senior Advocate Mukul Rohatgi argued that the statements not only disparaged a competitor but also promoted communal division, labeling them as “hate speech.” On the other hand, Patanjali’s counsel, Senior Advocate Rajiv Nayyar, contended that while the company does not oppose any religion, Ramdev’s personal opinions should not be censored.

The court has mandated that Ramdev file an affidavit within five days, pledging not to issue similar statements or advertisements in the future. The next hearing is scheduled for May 1.

This ruling underscores the judiciary’s commitment to maintaining communal harmony and upholding ethical advertising standards.
